SB 753: Special business regulations: shopping carts.
A city, county, or city and county can impound a shopping cart if it has a permanently affixed sign with the owner's information. The city, county, or city and county must provide a 3-day advance notice to the owner or their agent before impounding the cart. The cart can be retrieved and returned to the owner or retailer at no cost to the owner, but the city, county, or city and county can recover its actual costs for retrieval and return, not exceeding $100 per cart. The city, county, or city and county must maintain a record of proof of delivery of the notice. The city, county, or city and county can fine the owner for failure to retrieve shopping carts, with fines not exceeding $100 for each occurrence in a 6-month period, compared to $50 under existing law.
