A 10607: Prevents an increase in vehicular lane capacity of highways within two hundred feet of certain public housing facilities, in areas with high rates of asthma, and in environmental justice communities.
The bill aims to reduce the negative impacts of highway expansions in communities of color and low-income neighborhoods. It prohibits the increase of vehicular lane capacity in areas close to public housing developments, areas with high asthma rates, and environmental justice communities. The Commissioner of Transportation must conduct a safety and alternatives analysis before approving a project, which includes evaluating crash data, reasonable alternatives, and impacts on air quality and public health. The bill also requires the Commissioner to publish safety outcomes for a period of three years after project completion. The Commissioner must apply a clear and convincing evidentiary standard when making determinations. The bill takes effect immediately.
