A 11701: Clarifies that in resident-owned manufactured home communities, certain payments shall be deemed as rent solely for purposes of enforcement of certain eviction provisions; defines "resident-owned manufactured home community".

This bill amends the Real Property Law of New York to specifically define "resident-owned manufactured home communities" as parks where the land is owned by a cooperative, non-profit, or similar entity in which the majority of homeowners hold membership or voting rights. The legislation further establishes that any mandatory monthly occupancy charges or assessments in these specific communities will be legally classified as "rent." This reclassification is intended to allow homeowners to utilize existing legal summary proceedings for nonpayment of rent to enforce these charges. The act explicitly excludes condominiums, homeowner associations, and other common-interest communities from these provisions and clarifies that it does not create new statutory liens or alter existing rights under other laws. The bill is set to take effect immediately upon passage.
