What A 11709 does, verified September 27, 2026

This bill amends the Real Property Law of New York to exclude certain resident-owned manufactured home communities from specific provisions regarding rent increases. The law will no longer apply to manufactured home parks that have regulatory agreements with governmental entities to preserve affordable housing or limit rent hikes. Additionally, the provisions are exempted for communities that are owned and governed by resident-members, where monthly charges are used solely to recover operating expenses and costs, and where an affordability covenant or restriction is in place. The bill defines a resident-owned community as one where title is held by a cooperative, non-profit, or similar entity in which a majority of homeowners hold membership or voting rights in the park's management. The act takes effect immediately upon passage.
