What A 3494 does, verified January 8, 2026

The proposed law aims to ensure that institutions of higher education in New York provide sufficient documentation to establish that a student with a disability is eligible for accommodations. The law requires institutions to adopt a policy that accepts documentation of an individualized education program (IEP) submitted by an enrolled or admitted student as sufficient to establish the student's disability. Institutions can request additional documentation from students who had an IEP but exited high school before the institution's records were established. The law takes effect 60 days after it becomes a law, allowing institutions to implement the changes immediately upon its passage.
