What A 3959 does, verified January 12, 2026

The proposed law aims to protect grassland bird habitats during the development of major electric transmission facilities. It requires a mitigation ratio of three acres of conservation for every acre of occupied breeding habitat and three acres of mitigation for every acre of wintering habitat taken. The law ensures that the impact of habitat taken is not modified by dividing the area into smaller sections, to provide a net conservation benefit in designated grassland bird conservation centers. The amendments take effect immediately and apply to any major transmission facility or application for a major facility siting permit where the final net conservation benefit plan has not yet been approved.
