A 7418: Relates to notice of disclaimer of liability for certain revived causes of action; such notice shall occur within 120 days after the insurer has received actual notice of such revived claim or cause of action.
The bill aims to amend the insurance law to provide notice requirements for insurers who disclaim liability or deny coverage for certain claims. If an insurer disclaims liability or denies coverage for a claim related to a motor vehicle accident or other type of accident occurring in the state, they must provide written notice to the insured and the injured person or claimant as soon as possible. However, for revived civil claims or causes of action, insurers must provide written notice of a disclaimer of liability or denial of insurance coverage within 120 days after receiving actual notice of the revived claim or cause of action. The changes will take effect immediately and apply to all policies entered into on or before the effective date.
