A 7510: Authorizes state and municipal agencies to establish rules and regulations for the use, distribution, duplication, sale and resale of geographic information systems materials disclosed under the freedom of information law; authorizes the imposition of fees for copies of such materials which do not exceed the fair market value of the materials; establishes such rules and regulations shall be consistent with those adopted by the committee on open government; authorizes applicants to appeal the reasonableness of any fees imposed therefor.
The proposed law aims to regulate the use, distribution, and sale of geographic information systems (GIS) materials by state and municipal agencies. The law allows agencies to establish rules and regulations for the use of GIS materials, including conditions for access and distribution. These rules must be consistent with general guidelines promulgated by the Committee on Open Government. Agencies may also set fees for copies of GIS materials, but these fees must not exceed the fair market value of the materials. If an applicant disputes the fee, they can appeal to the agency's governing body, which must determine whether to approve or reduce the fee within 10 business days. The agency must then forward the appeal and its decision to the Committee on Open Government. The law takes effect immediately.
