A 8991: Establishes a right-to-repair for military property by requiring the adjutant general procure goods and services with fair and reasonable access to repair materials.
The New York State Servicemember Right-to-Repair Act aims to improve access to repair services for military property. The act requires that contractors provide fair and reasonable access to repair materials, including parts, tools, and information. This access must allow the state to diagnose, maintain, or repair goods and services at prices and terms equivalent to those offered by the manufacturer. In cases where a manufacturer does not offer parts or information to authorized repair providers, the state may determine fair and reasonable prices and terms. The act takes effect immediately, ensuring that the state has greater control over the procurement of goods and services for military purposes.
