S 4817: Removes residency requirements for persons holding the office of assistant district attorney for the county of Franklin; provides that a person holding such office may reside in Franklin county or an adjoining county within the state.
The bill aims to amend the Public Officers Law to remove the residency requirement for Franklin County Assistant District Attorneys. Currently, the law requires individuals to be residents of the political subdivision or municipal corporation for which they are chosen or within which their official functions are exercised. However, the bill proposes to exempt individuals holding the office of Assistant District Attorney in Franklin County, allowing them to reside in either Franklin County or an adjoining county within New York State. This change will not apply to First Assistant District Attorneys or Chief Assistant District Attorneys, who would assume the duties of the District Attorney in the event of their absence or inability to perform their duties. The bill takes effect immediately.
