S 7684: Relates to the New York State medical indemnity fund account payments; extends provisions relating to payments from the New York state medical indemnity fund; provides for the repeal of certain provisions upon the expiration thereof.
The bill aims to amend the public health law to address the New York State Medical Indemnity Fund account payments. The changes include: The suspension of enrollment will not impact payment for qualified plaintiffs already enrolled in the fund for the remainder of their life, and payments will continue even if total expenditures exceed available appropriation authority. The state comptroller must transfer money from the state treasury into the fund account each year to avoid suspension of new enrollment. Any appropriation or appropriations in the state budget that authorizes disbursement of funds from the fund account must increase by an amount necessary to support new enrollment. The bill also addresses the effectiveness of the amendments by setting the effective date of the amendments to the public health law and the repeal of certain provisions upon expiration.
