The bill requires public schools to include fetal development instruction as part of any instruction addressing human growth, development, or human sexuality. This instruction will begin in the 2026-2027 school year and must be evidence-based and aligned with other subjects such as health education, social inclusion, and physical education. Schools must also include instruction in suicide awareness and prevention, safety training and violence prevention, and physical education. To amend sections 3313.60, 3314.03, 3326.11, and 1 3328.24 and to enact section 3313.6034 of the 2 Revised Code to require public schools to 3 include fetal development instruction in any 4 instruction that addresses human growth, 5 development, or sexuality. 6

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1. That sections 3313.60, 3314.03, 3326.11, and 7 3328.24 be amended and section 3313.6034 of the Revised Code be 8 enacted to read as follows:

Sec. 3313.60. Notwithstanding division (D) of section 10 3311.52 of the Revised Code, divisions (A) to (E) of this 11 section do not apply to any cooperative education school 12 district established pursuant to divisions (A) to (C) of section 13 3311.52 of the Revised Code.

(A) The board of education of each city, exempted village, 15 and local school district and the board of each cooperative 16 education school district established, pursuant to section 17 3311.521 of the Revised Code, shall prescribe a curriculum for 18 all schools under its control. Except as provided in division 19 (E) of this section, in any such curriculum there shall be ..... 20 included the study of the following subjects: ..... 21 (1) The language arts, including reading, writing, ..... 22 spelling, oral and written English, and literature; ..... 23 (2) Geography, the history of the United States and of ..... 24 Ohio, and national, state, and local government in the United ..... 25 States, including a balanced presentation of the relevant ..... 26 contributions to society of men and women of African, Mexican, ..... 27 Puerto Rican, and American Indian descent as well as other ..... 28 ethnic and racial groups in Ohio and the United States; ..... 29 (3) Mathematics; ..... 30 (4) Natural science, including instruction in the ..... 31 conservation of natural resources; ..... 32 (5) Health education, which shall include instruction in: ..... 33 (a) The nutritive value of foods, including natural and ..... 34 organically produced foods, the relation of nutrition to health, ..... 35 and the use and effects of food additives; ..... 36 (b) The harmful effects of and legal restrictions against ..... 37 the use of drugs of abuse, alcoholic beverages, and tobacco, ..... 38 including electronic smoking devices; ..... 39 (c) Sexually transmitted infection education, except that ..... 40 upon written request of the student's parent or guardian, a ..... 41 student shall be excused from taking instruction in sexually ..... 42 transmitted infection education; ..... 43 (d) In grades kindergarten through six, annual ..... 44 developmentally appropriate instruction in child sexual abuse ..... 45 prevention, including information on available counseling and ..... 46 resources for children who are sexually abused. Such instruction ..... 47 and information provided shall not be connected in any way to ..... 48 any individual, entity, or organization that provides, promotes, ..... 49 counsels, or makes referrals for abortion or abortion-related ..... 50 services. Upon written request of the student's parent or ..... 51 guardian, a student shall be excused from taking instruction in ..... 52 child sexual abuse prevention. (e) In grades kindergarten through six, instruction in ..... 54 personal safety and assault prevention, except that upon written ..... 55 request of the student's parent or guardian, a student shall be ..... 56 excused from taking instruction in personal safety and assault ..... 57 prevention; (f) In grades seven through twelve, developmentally ..... 59 appropriate instruction in dating violence prevention education ..... 60 and sexual violence prevention education, which shall include ..... 61 instruction in recognizing dating violence warning signs and ..... 62 characteristics of healthy relationships, except that upon ..... 63 written request of the student's parent or guardian a student ..... 64 shall be excused from taking instruction in sexual violence ..... 65 prevention. In order to assist school districts in developing a dating ..... 67 violence prevention education and sexual violence prevention ..... 68 education curriculum, the department of education and workforce ..... 69 shall provide on its web site links to free curricula addressing ..... 70 dating violence prevention and sexual violence prevention ..... 71 education. Such instruction and information shall not be ..... 72 connected in any way to any individual, entity, or organization ..... 73 that provides, promotes, counsels, or makes referrals for ..... 74 abortion or abortion-related services. Each school district shall notify the parents and legal ..... 76 guardians of students who receive instruction related to child ..... 77 sexual abuse prevention and sexual violence prevention, as ..... 78 described under divisions (A) (5) (d) and (f) of this section, of ..... 79 all of the following: (i) That instruction in child sexual abuse prevention and ..... 81 sexual violence prevention is a required part of the district's ..... 82 curriculum; (ii) That upon request, parents and legal guardians may ..... 84 examine such instructional materials in accordance with this ..... 85 section; (iii) That upon written request of the student's parent or ..... 87 guardian, a student shall be excused from taking instruction in ..... 88 child sexual abuse prevention and sexual violence prevention. ..... 89 If the parent or legal guardian of a student less than ..... 90 eighteen years of age submits to the principal of the student's ..... 91 school a written request to examine the dating violence ..... 92 prevention and sexual violence prevention instruction materials ..... 93 used at that school, the principal, within forty-eight hours ..... 94 after the request is made, shall allow the parent or guardian to ..... 95 examine those materials at that school. (g) Prescription opioid abuse prevention, with an emphasis ..... 97 on the prescription drug epidemic and the connection between ..... 98 prescription opioid abuse and addiction to other drugs, such as ..... 99 heroin; (h) The process of making an anatomical gift under Chapter ..... 101 2108. of the Revised Code, with an emphasis on the life-saving ..... 102 and life-enhancing effects of organ and tissue donation; (i) Beginning with the first day of the next school year ..... 104 that begins at least two years after March 24, 2021, in grades ..... 105 six through twelve, at least one hour or one standard class ..... 106 period per school year of evidence-based suicide awareness and ..... 107prevention and at least one hour or one standard class period108 per school year of safety training and violence prevention, ..... 109 except that upon written request of the student's parent or ..... 110 guardian, a student shall be excused from taking instruction in ..... 111 suicide awareness and prevention or safety training and violence ..... 112 prevention; (j) Beginning with the first day of the next school year ..... 114 that begins at least two years after March 24, 2021, in grades ..... 115 six through twelve, at least one hour or one standard class ..... 116 period per school year of evidence-based social inclusion ..... 117 instruction, except that upon written request of the student's ..... 118 parent or guardian, a student shall be excused from taking ..... 119 instruction in social inclusion. For the instruction required under divisions (A) (5) (i) and ..... 121 (j) of this section, the board shall use a training program ..... 122 approved by the department of education and workforce under ..... 123 section 3301.221 of the Revised Code. Schools may use student assemblies, digital learning, and ..... 125 homework to satisfy the instruction requirements under divisions ..... 126 (A) (5) (i) and (j) of this section. (k) Beginning in the 2026-2027 school year, fetal ..... 128 development instruction in accordance with section 3313.6034 of ..... 129 the Revised Code as part of any instruction addressing human ..... 130 growth, human development, or human sexuality. ..... 131 (6) Physical education; ..... 132 (7) The fine arts, including music; ..... 133 (8) First aid, including a training program in ..... 134 cardiopulmonary resuscitation, which shall comply with section ..... 135 3313.6021 of the Revised Code when offered in any of grades nine ..... 136 through twelve, safety, and fire prevention. A board ..... 144 may waive this requirement for academically accelerated students ..... 145 who, in accordance with procedures adopted by the board, are ..... 146 able to demonstrate mastery of essential concepts and skills of ..... 147 the eighth grade American history course of study. ..... 148 (C) As specified in divisions (B) (6) and (C) (6) of section ..... 149 3313.603 of the Revised Code, except as provided in division (E) ..... 150 of this section, every high school shall include in the ..... 151 requirements for graduation from any curriculum one-half unit ..... 152 each of American history and government. ..... 153 (D) Except as provided in division (E) of this section, ..... 154 basic instruction or demonstrated mastery in geography, United ..... 155 States history, the government of the United States, the ..... 156 government of the state of Ohio, local government in Ohio, the ..... 157 Declaration of Independence, the United States Constitution, and ..... 158 the Constitution of the state of Ohio shall be required before ..... 159 pupils may participate in courses involving the study of social ..... 160 problems, economics, foreign affairs, United Nations, world ..... 161 government, socialism, and communism. ..... 162 (E) For each cooperative education school district ..... 163 established pursuant to section 3311.521 of the Revised Code and ..... 164 each city, exempted village, and local school district that has ..... 165 territory within such a cooperative district, the curriculum ..... 166 adopted pursuant to divisions (A) to (D) of this section shall ..... 167 only include the study of the subjects that apply to the grades ..... 168 operated by each such school district. The curricula for such ..... 169 schools, when combined, shall provide to each student of these ..... 170 districts all of the subjects required under divisions (A) to ..... 171 (D) of this section. (F) The board of education of any cooperative education ..... 173 school district established pursuant to divisions (A) to (C) of ..... 174 section 3311.52 of the Revised Code shall prescribe a curriculum ..... 175 for the subject areas and grade levels offered in any school ..... 176 under its control. (G) Upon the request of any parent or legal guardian of a ..... 178 student, the board of education of any school district shall ..... 179 permit the parent or guardian to promptly examine, with respect ..... 180 to the parent's or guardian's own child: (1) Any survey or questionnaire, prior to its ..... 182 administration to the child; (2) Any textbook, workbook, software, video, or other ..... 184 instructional materials being used by the district in connection ..... 185 with the instruction of the child; (3) Any completed and graded test taken or survey or ..... 187 questionnaire filled out by the child; (4) Copies of the statewide academic standards and each ..... 189 model curriculum developed pursuant to section 3301.079 of the ..... 190 Revised Code, which copies shall be available at all times ..... 191 during school hours in each district school building.

Sec. 3313.6034. Each city, local, exempted village, and ..... 193 joint vocational school district shall include instruction on ..... 194 fetal development in any instruction that addresses human ..... 195growth, human development, or human sexuality. The fetal196 development instruction shall include a high-quality, computer- ..... 197 generated animation or a high-definition ultrasound video, at ..... 198 least three minutes in duration, showing the development of the ..... 199 brain, heart, and other vital organs in early fetal development.

Sec. 3314.03. A copy of every contract entered into under ..... 201 this section shall be filed with the director of education and ..... 202 workforce. The department of education and workforce shall make ..... 203 available on its web site a copy of every approved, executed ..... 204 contract filed with the director under this section.

(A) Each contract entered into between a sponsor and the ..... 206 governing authority of a community school shall specify the ..... 207 following:

  1. That the school shall be established as either of the ..... 209 following:
    1. (a) A nonprofit corporation established under Chapter ..... 211 1702. of the Revised Code, if established prior to April 8, ..... 212 2003;

  2. The education program of the school, including the ..... 216 school's mission and educational philosophy, the characteristics ..... 217 of the students the school is expected to attract, the ages and ..... 218 grades of students, and the focus of the curriculum; ..... 219
  3. The academic goals to be achieved and the method of ..... 220 measurement that will be used to determine progress toward those ..... 221 goals, which shall include the statewide achievement ..... 222 assessments; ..... 223

  7. The ways by which the school will achieve racial and ..... 238 ethnic balance reflective of the community it serves; ..... 239

  5. Have in place a plan of action to be undertaken in the ..... 538 event the community school experiences financial difficulties or ..... 539 closes prior to the end of a school year. ..... 540

(D) Upon the expiration of a contract entered into under this section, the sponsor of a community school may, with the approval of the governing authority of the school, renew that contract for a period of time determined by the sponsor, but not ending earlier than the end of any school year, if the sponsor finds that the school's compliance with applicable laws and terms of the contract and the school's progress in meeting the academic goals prescribed in the contract have been satisfactory. Any contract that is renewed under this division remains subject to the provisions of sections 3314.07,3314.072, and 3314.073 of the Revised Code.

(E) If a community school fails to open for operation within one year after the contract entered into under this section is adopted pursuant to division (D) of section 3314.02 of the Revised Code or permanently closes prior to the expiration of the contract, the contract shall be void and the school shall not enter into a contract with any other sponsor. A school shall not be considered permanently closed because the operations of the school have been suspended pursuant to section 3314.072 of the Revised Code.

Sec. 3326.11.
