To enact section 1345.29 of the Revised Code to 1
require disclosure of credit card surcharges. 2

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

Section 1. That section 1345.29 of the Revised Code be 3
enacted to read as follows: 4

Sec. 1345.29. (A) A supplier shall provide prominent, 5
written disclosure at the point of sale of any fees or 6
surcharges for using a credit card as a part of, or in relation 7
to, a consumer transaction. 8

(B) (1) A failure to comply with division (A) of this 9
section shall be considered an unfair and deceptive practice 10
under section 1345.02 of the Revised Code. 11

(2) (a) All powers and remedies available to the attorney 12
general to enforce sections 1345.01 to 1345.13 of the Revised 13
Code as regards an unfair or deceptive act or practice are 14
available to the attorney general to enforce division (A) of 15
this section. 16

(b) All remedies available to consumers under section 17
1345.09 of the Revised Code to remedy violations of section 18
1345.02 of the Revised Code are available to consumers to remedy 19
a failure to comply with division (A) of this section. 20

(C) As used in this section, "consumer," "consumer 21
transaction," and "supplier" have the same meanings as in 22
section 1345.01 of the Revised Code. 23
