SB 380: Prohibit laws incompatible with U.S. and Ohio Constitutions

and to name this act An Act to Affirm and Ensure 4
the Supremacy of the Constitutions of the United 5
States of America and Ohio and the Foundational 6
Principle of the American System of Government: 7
Individual Liberty. 8
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
That section 1.66 of the Revised Code be 9
enacted to read as follows: 10
(A) As used in this section: 11
"Incompatible law" means any law, rule, or regulation 12
of a jurisdiction outside any state or territory of the United 13
States that does not provide the same or equivalent rights and 14
liberties guaranteed under the United State Constitution, the 15
Ohio Constitution, or the common law as recognized in this 16
state.
"Religious law, custom, or practice" means any law, 18
rule, or regulation of a religious system, belief, code, or 19
ethnic or tribal custom or practice that is incompatible with 20
the United State Constitution, Ohio Constitution, or the common 21
law as recognized in this state. 22
"Government entity" means a state agency, public 23
institution, political subdivision, or any other organized body, 24
office, agency, institution, or entity established by the laws 25
of this state for the exercise of any function of government. 26
(B) Notwithstanding any other provision of the Revised 27
Code, no government entity shall recognize or enforce any 28
incompatible law or any religious law, custom, or practice that 29
permits, enforces, or implements any of the following: 30
Prejudicial treatment of women or persons of a 31
particular race, religion, ethnicity, social class, or caste: 32
Prohibition of the right to leave, change, or renounce 33
one's religion or belief: 34
Prohibition of otherwise protected speech or assembly: 35
Plural marriages: 36
Marriages of convenience or contracts for sexual 37
services: 38
Forced marriages or marriages that are otherwise 39
unlawful under the laws of this state: 40
Violence against women and children, excluding 41
reasonable parental discipline of children: 42
Politically or religiously motivated physical violence 43
or homicide: 44
Cruel and unusual punishments as prohibited by the 45
Eighth Amendment to the United States Constitution, including 46
amputation, lashing, flogging, stoning, branding, or piercing: 47
(10) Female genital mutilation; 48
(11) Human sacrifice. 49
This act shall be known as An Act to Affirm and 50
Ensure the Supremacy of the Constitutions of the United States 51
of America and Ohio and the Foundational Principle of the 52
American System of Government: Individual Liberty. 53
