What AB 1281 does, verified January 14, 2026

This bill amends existing law to increase the punishment for a driver who leaves the scene of an accident resulting in injury or death. Currently, the punishment is imprisonment in the state prison for 2, 3, or 4 years, or in a county jail for 90 days to one year, or a fine. Under the proposed change, the punishment would increase to imprisonment in the state prison for 7, 8, or 9 years if the accident results in permanent, serious injury or death.
