AB 1604: Product safety: proofs of purchase: intentionally added bisphenols.

The bill aims to improve product safety by regulating the use of intentionally added bisphenols in paper proof of purchase products. It prohibits the use of bisphenol A starting January 1, 2027, and any other bisphenol by January 1, 2028. Violators may face a civil penalty of up to $5,000 for the first offense and up to $10,000 for subsequent offenses. The collected penalties will be deposited into a toxic substances control account for use by the department of toxic substances control. Manufacturers must use the least toxic alternative when replacing bisphenols and cannot replace them with chemicals known to cause cancer or reproductive harm. A prevailing plaintiff who establishes a violation may receive an award of reasonable attorney's fees and costs.
