AB 2040: Juveniles: transfer to court of criminal jurisdiction.
What AB 2040 does, verified April 30, 2026
This bill proposes to amend the law regarding juveniles in the court system. Currently, a court must find that a minor is not amenable to rehabilitation in order to transfer them to a court of criminal jurisdiction. The proposed bill would change this standard to require that the court find it more likely than not (by a preponderance of evidence) that the minor is not amenable to rehabilitation. This change aims to make it easier for courts to transfer minors to a court of criminal jurisdiction in cases where they have committed serious offenses.
