AB 2249: Cannabis: labels, packaging, and advertising.
<p>The bill amends and adds sections to California's Business and Professions Code regarding cannabis labels, packaging, and manufacturing. It prohibits the sale, distribution, or manufacture of cannabis products that are attractive to children, including those featuring images of real or fictional humans. The Department of Cannabis Control is required to develop a standardized rubric by July 1, 2027, for determining if cannabis goods are appealing to children. Additionally, the department must establish a process allowing licensees to request written determinations on whether proposed packaging or labeling would be attractive to children, without requiring this as a condition of licensure.</p>

The people of the State of California do enact as follows:
SECTION 1.
Section 26141 is added to the Business and Professions Code, to read:26141.
(a) For purposes of subdivision (b) of Section 26120 or subdivision (f) of Section 26152, “attractive to children” means designed or likely to appeal to individuals under 21 years of age, which may be indicated by, but not limited to, any of the following:SEC. 2.
Section 26142 is added to the Business and Professions Code, to read:26142.
(a) The department shall develop compliance assessment resources to assist licensees in self-evaluating whether packaging or labeling is attractive to children.
