What AB 36 does, verified December 7, 2025

This bill would require the department of housing and community development to designate jurisdictions as prohousing under permanent regulations, rather than emergency regulations. The bill would also allow small rural jurisdictions to request a prohousing designation, and would evaluate their housing elements in this process. Small rural jurisdictions with compliant housing elements would be eligible for the designation. The designation would not need to be renewed for at least 4 years. The bill defines small rural jurisdictions as cities with a population of fewer than 25,000 persons or counties with a population of fewer than 200,000 persons.
