AB 565: Representation of trust beneficiaries.
The bill aims to repeal and add a new section to the probate code regarding trusts. It establishes procedures for trust creation, modification, and termination, as well as administration by trustees on behalf of beneficiaries. The bill requires notice to be given to a person authorized to represent and bind another person, which is deemed sufficient to comply with notice requirements. This person must provide written consent to be bound, and their consent is binding unless they object before it takes effect. Certain individuals are prohibited from representing and binding others, and the bill allows for authorized representative relationships and representation of successive interests.
