AB 858: Employment: rehiring and retention: displaced workers.

This bill would extend the provisions related to rehiring and retention of displaced workers until January 1, 2027. The provisions require employers to offer information about available job positions to laid-off employees who were employed for 6 months or more and whose separation was due to the COVID-19 pandemic. The employer must also offer these employees preference in hiring based on specified timelines and procedures. Additionally, the employer cannot refuse to employ or take adverse action against a laid-off employee for seeking to enforce their rights under these provisions. The provisions also create a presumption that a separation due to a lack of business or other economic reasons is related to the COVID-19 pandemic unless the employer can prove otherwise.
