SB 328: California Environmental Quality Act: exempt surplus land.
This bill aims to improve the regulation of hazardous waste in California. The Department of Toxic Substances Control (DTSC) will provide written notice to requestors within specified timelines regarding subsequent actions in the review process for housing development projects. For developments with 25 units or fewer, notice must be provided within 60 business days, while for developments with 26 units or more, notice must be provided within 120 business days. These provisions will take effect on July 1, 2028. The bill also introduces new fees for generators of hazardous waste. Residential infill housing generators are limited to a maximum fee of $100,000, while master development projects are limited to a maximum fee of $250,000. These fees apply to generators that are not responsible for creating the hazardous waste and must be certified by the DTSC.
