SB 46: Presidential elections: qualifications for office.
This bill aims to amend the elections code to ensure presidential candidates meet qualifications for office. The secretary of state will no longer place a candidate's name on the ballot unless the candidate affirms, under oath, that they will meet the qualifications of the office. If the secretary of state has reasonable suspicion that a candidate does not meet the qualifications, they can investigate and request proof. Electors and candidates can challenge the secretary of state's determination by filing a petition in court. The court will hold a hearing and issue a decision within a specified timeframe. The bill also clarifies that no reimbursement is required for certain costs.
