SB 635: Food vendors and facilities: enforcement activities.

This bill aims to regulate the enforcement of local government regulations on sidewalk vendors and compact mobile food operations. A local authority cannot provide voluntary access to records of sidewalk vendors without a subpoena or judicial warrant, nor can they disclose personally identifiable information of vendors except in these situations. The bill prohibits local authorities and enforcement agencies from inquiring into or collecting immigration status, citizenship status, or criminal history of vendors or applicants. Records related to these inquiries must be destroyed on or before March 1, 2026, unless required by law to be preserved. Enforcement agencies cannot use moneys or personnel to investigate or arrest individuals for purposes related to sidewalk vendors, nor engage in specified immigration enforcement activities.
