What SB 733 does, verified December 8, 2025

The bill would amend the penal code to allow a sexual assault survivor aged 18 or older who is undecided about reporting to law enforcement at the time of an examination to request that all medical evidence collected from them not be tested. If the request is made at the time of the examination, the medical facility would not submit the kit to a crime laboratory, and the investigating agency would retain the kit until the survivor requests testing. If the request is made after the examination, the investigating agency would retain the kit or return it to the agency to be retained. A survivor who requests that their kit not be tested can later request that it be tested. The bill would create a new duty for local investigating agencies, imposing a state-mandated local program. Reimbursement for costs mandated by the state would be made pursuant to statutory provisions.
