SB 838: Housing Accountability Act: housing development projects.

California · Senate · 2025–2026 Regular Session · last verified December 8, 2025

What SB 838 does, verified December 8, 2025

This bill aims to amend the Housing Accountability Act to clarify the definition of a housing development project. A housing development project is a mixed-use development that consists of residential and nonresidential uses, with at least 2/3 of the new or converted square footage designated for residential use. The bill requires that no portion of the project be designated for use as a hotel, motel, bed and breakfast inn, or other transient lodging, except in certain circumstances. The bill also corrects cross-references in the act and incorporates additional changes proposed in another bill, making it operative only if both bills are enacted and this bill is enacted last.
