Senate BillIntroduced
S 3206: Prevents individuals from being denied standing in private actions alleging violations of the environmental quality review provisions of the environmental conservation law solely on the basis that the injury alleged by such individual does not differ in kind or degree from the injury that would be suffered by the public at large.
What S 3206 does, verified January 12, 2026
The Environmental Access to Justice Act aims to enhance the rights of individuals seeking environmental justice. The law will ensure that individuals who file a lawsuit under the Environmental Conservation Law are not denied standing based on the severity of the alleged injury. This change will allow private individuals to bring lawsuits against polluters, even if the harm they suffer is similar to the harm suffered by the general public. The law will take effect immediately, providing a new framework for environmental justice cases.
