AB 2125: Groundwater basin adjudication: notice.

this bill would amend the code of civil procedure to require a plaintiff filing a notice of commencement of groundwater basin adjudication to provide additional notice procedures to defendants, including mailing the notice, complaint, and form answer to holders of fee title to real property in the basin, and posting the notice in a conspicuous place on the real property if a return receipt is not received. the bill would also require the plaintiff to include an affidavit with the notice of completion of mailing stating the date, time, and place of mailing, as well as the certified or registered mail delivery receipt for each parcel. if a return receipt is not received, the bill would require the plaintiff to include an affidavit of the person who posted the notice, specifying the date, time, and physical location of each parcel where the posting occurred, accompanied by a photograph dep…
