What AB 381 does, verified December 6, 2025

This bill requires contractors to certify that they have implemented a compliance plan to prevent forced labor and human trafficking in their supply chains. The certification must be provided before a contract is awarded and must include a statement that the contractor has conducted due diligence to ensure compliance. Contractors must also notify employees of prohibited activities and provide information to the contracting officer and state agency if a violation is suspected. The bill authorizes additional sanctions for contractors who fail to comply, including removing a contractor employee from the performance of the contract, terminating a subcontractor, and suspending contract payments. Contractors can request a hearing before an administrative law judge to contest the sanctions, but the judge can consider mitigating and aggravating factors.
